Wage theft

Any time an employer fails to pay wages or tips you earned, such as missing hours, unpaid overtime, kept tips or illegal deductions.

Wage theft is the plain-language name for unpaid wages. In restaurants it usually looks like one of these:

  • Hours cut from the timecard, or work before clock-in.
  • Overtime paid at the wrong rate, or not at all.
  • A tip credit taken when tips did not cover the minimum wage.
  • Managers taking from the tip pool.
  • Deductions for walkouts, breakage or uniforms that are not allowed.

Many of these are payroll mistakes and get fixed once someone points them out. If not, you can file a wage claim. See what to do if you were underpaid.
